Terms of Service — Realtime Chess

§ 1 Scope

These Terms of Service govern the use of the mobile application "Realtime Chess" (hereinafter "App") as well as the associated website and game server, provided by:

By using the App, the user agrees to these Terms of Service.

§ 2 Description of Service

The App is a free real-time chess game where both players move simultaneously. It includes, among others, the following features:

• Online multiplayer (realtime, blitz, and items modes)
• AI opponents (difficulty levels 1–10)
• Local two-player mode
• Daily chess puzzles
• Elo rating system
• Cosmetic rewards and leveling system
• Replay and analysis features

§ 3 Usage Requirements

No registration or user account is required to use the App. No personal data such as name, email address, or password is collected.

For online matches, temporary, randomly generated player tokens are used that do not enable cross-session identification. These tokens are automatically deleted after the game ends.

§ 4 Availability

The Provider endeavors to ensure the App and game server are available without interruption. However, no claim to uninterrupted availability exists. The Provider reserves the right to restrict the operation of the App or the server in whole or in part at any time if this is necessary for technical or operational reasons (e.g., maintenance, updates, server migration).

The Provider is not liable for outages caused by force majeure, disruptions to telecommunications networks, or other circumstances beyond the Provider's control.

§ 5 Intellectual Property

All rights to the App, including source code, design, graphics, sounds, and texts, belong to the Provider or the respective licensors. Open-source components used are subject to their respective licenses, which can be viewed within the App.

Use of the App does not entitle the user to reproduce, distribute, modify, or otherwise exploit the contents beyond the intended use.

§ 6 User Conduct

The user agrees to use the App only for its intended purpose. In particular, the following is prohibited:

• Using chess engines, bots, or other automated tools during online matches (cheating);
• Impairing the App or game server through automated requests, excessive use, or deliberate overloading;
• Decompiling the App, extracting source code, or reverse engineering, unless permitted by mandatory law;
• Using the App's communication features (e.g., emoji chat) for harassing, offensive, or unlawful behavior;
• Circumventing or manipulating the App's security mechanisms (e.g., HMAC signing, rate limiting).

In case of violations, the Provider reserves the right to restrict the user's access to the online game server.

§ 7 Limitation of Liability

The Provider's liability is governed by the following provisions:

• The Provider is fully liable for damages caused by intent or gross negligence, as well as for damages resulting from injury to life, body, or health.
• For slight negligence, the Provider is only liable in case of breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to the foreseeable, typically occurring damage.
• Beyond this, liability for slight negligence is excluded.

This limitation of liability also applies to the Provider's vicarious agents.

§ 8 Disclaimer of Warranty

The App is provided "as is." The Provider makes no guarantees or warranties regarding the accuracy, completeness, timeliness, or fitness of the App for a particular purpose, to the extent permitted by law.

This applies in particular to the results of game analysis, Elo ratings, and the availability of online gameplay.

§ 9 Changes to the Terms

The Provider reserves the right to amend these Terms of Service at any time with effect for the future. The current version is available in the App and on the Provider's website. By continuing to use the App after a change, the user agrees to the amended Terms of Service.

§ 10 Final Provisions

Should any provision of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected (severability clause).

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction, to the extent permitted by law, is Tübingen, Germany.
